Monika’s practice focuses on complex commercial and antitrust litigation, including actions involving bankruptcy, copyright infringement, RICO claims, and white collar, civil, and common law fraud.

Her practice has concentrated on litigation stemming from the 2008 global financial crisis, representing trustees of residential mortgage-backed securitizations (RMBS) in actions seeking to recover damages from the investment banks.

Prior to joining Glenn Agre Bergman & Fuentes, Monika was an associate in McKool Smith’s New York office. She also worked on plaintiff-side qui tam litigation on the New York City, State, and federal level, and engaged in mediation, arbitration, and litigation before international boards and tribunals in her representation of United Nations staff members and other international civil servants in their employment claims.

Monika has represented:

  • Trustees of residential mortgage-backed securities trusts in numerous loan repurchase and breach of contract “put-back” actions against major financial institutions.
  • Federal Housing Finance Agency, as conservator for Fannie Mae and Freddie Mac, in several actions in federal court against numerous financial institutions arising out of defendants’ misrepresentations concerning residential mortgage-backed securities.
  • Approximately 1,500 coal miners in a consolidated action in Alabama and West Virginia arising from exposure to isocyanate-based products in underground coal mines.
  • Comcast Corporation in three antitrust class actions brought by a putative class of two million subscribers in each case.
  • Individual consumers in a class action lawsuit in pharmaceutical case involving RICO an civil and common law fraud claims.
