Partners Christopher Johnson and Zachary Mazin spoke with Inside Mortgage Finance about where they see structured finance litigation heading, in an article covering the expansion of the firm’s Structured Financial Products Litigation practice.

Chris, who has spent almost two decades litigating disputes over securitizations that don’t “match the representations behind them,” noted that the private credit market has a generation of structures with less disclosure, fewer public filings and the same question: did the underlying assets ever match the deal documents? He said these cases are still to come and will be fought in bankruptcy courts and federal courts simultaneously. “Glenn Agre is one of the few firms built to do both,” Chris said.

When it comes to areas of interest, Chris and Zach said they are keeping an eye on distress in the commercial multifamily sector. The article also points to liability management, which is led at Glenn Agre by the firm’s Bankruptcy Litigation practice and its transactional Distressed Debt, Claims Trading, and Special Situations Investing practice.

The firm represents lenders, borrowers, investors, creditors, trustees and litigation trustees in disputes tied to ABS, warehouse facilities, collateralized loan obligations and other products. Chris joined the firm in September as the fourth attorney to join the practice this year, following Zach and special counsel Ayana Rivers and Monika Bileris, who joined in June.
