Glenn Agre Bergman & Fuentes LLP achieved a decisive victory in the New York Supreme Court, Commercial Division, securing the full dismissal of claims asserted against its client, Ninety-Five Madison Company, L.P., in the matter of Ninety-Five Madison Company, L.P. v. Kinder Realty Associates, et al.

The case arose from a dispute concerning the management and sale of 95 Madison Avenue, a commercial property sold for $65 million in 2024 through Chapter 11 bankruptcy. The counterclaims against various parties alleged unjust enrichment, conversion, breach of contract, breach of fiduciary duty, and violations of the Uniform Voidable Transactions Act – seeking millions in damages.

At oral argument on January 29, 2026, before the Hon. Anar Rathod Patel, associate Rich Ramirez presented argument on behalf of NFMC on key claims.
