Glenn Agre Bergman & Fuentes secured a significant win for clients Svalbard Holdings Ltd. and Attestor Value Master Fund LP before the Delaware Supreme Court.
On April 29, 2026, the court affirmed the Court of Chancery’s dismissal of claims brought by SPCP Group LLC, an affiliate of hedge fund Silver Point Capital, arising from a failed attempt to purchase a multimillion-dollar bankruptcy claim tied to the collapse of FTX Trading Ltd. The court agreed that Delaware lacked personal jurisdiction over the dispute, affirming Vice Chancellor Morgan T. Zurn’s August 2025 ruling in full.
Partner Skye Tian Gao argued the appeal, and along with Andrew K. Glenn, steered the case to a successful outcome at both the trial and appellate levels. As Skye noted, the decision “reinforces fundamental rules of personal jurisdiction and underscores that creditors in a Chapter 11 case are not subject to state court jurisdiction simply by participating in the bankruptcy.” This is a precedent-setting ruling on issues of first impression in Delaware and beyond.
