Agustina’s practice focuses on bankruptcy and restructuring, representing both debtors and creditors in large, complex Chapter 11 cases, out of court restructurings, and bankruptcy litigation disputes. She also has extensive experience counseling clients in a wide range of transactions involving indentures and other debt instruments.

Prior to joining Glenn Agre Bergman & Fuentes, Agustina was an associate at Willkie Farr and Gallagher LLP. Before that, she was an associate at Weil, Gotshal & Manges LLP.

Agustina has represented:

  • The ad hoc group of unsecured noteholders in connection with the Hertz Corporation’s Chapter 11 restructuring; also served as counsel to indenture trustee in connection with ongoing make-whole and postpetition interest litigation.
  • The reorganized debtors in connection with ongoing litigation concerning the reorganized debtors’ Chapter 11 restructuring of Sanchez Energy Corporation’s midstream operations.
  • The administrative agent for Southland Royalty Company’s reserve-based loan facility in connection with a lawsuit challenging Southland’s ability to sell assets free and clear of obligations under a gas gathering agreement.
  • Trident Holding Company’s former CEO and CFO in connection with a lawsuit challenging Trident’s 2018 out-of-court restructuring.
  • The ad hoc group of secured noteholders in connection with pre-packaged Chapter 11 restructuring of Northwest Hardwoods, Inc.
  • One of Le Tote Inc.’s largest creditors in connection with Le Tote’s Chapter 11 restructuring.
  • An ad hoc group of lenders and noteholders of Talen Energy as conflicts counsel.
